Jacob Gordon · Former Insurance Defense Attorney Florida Product Liability Lawyer

I've defended product liability cases. Now I hold manufacturers responsible.

An airbag doesn’t deploy. A seatbelt unlatches. A tire tread separates at highway speed. A roof crushes in a rollover that should have been survivable.

When a product fails, the company that made it can be responsible. These cases are often the difference between a small recovery and a full one.

Why insurance companies take me seriously.

I know how corporations defend. They blame the user, the other driver, or “misuse.” I know how to answer each one.

I protect the evidence. In a vehicle defect case, the vehicle is the evidence. If it gets salvaged or crushed, the case can be lost. I act fast to preserve it.

I look past the obvious claim. A car crash case may also be a defect case. I review every serious crash for product failures.

I’m ready for trial. I tried 20 jury trials as a prosecutor and have handled 500+ litigated cases. I prepare every case like it’s going in front of a jury, and I’ll take it there if that’s what it takes.

Florida product liability law in plain English.

Strict liability. A manufacturer or seller can be held strictly liable for a defective product. You prove the product was defective and the defect caused your injury.

Three kinds of defects. Design defects, manufacturing defects, and failure to warn.

Crashworthiness. Vehicles must protect you in a crash. If a defect made your injuries worse, the manufacturer can be responsible for that added harm.

Deadlines are different. Product cases have their own deadlines, plus a statute of repose tied to the product’s age. Don’t wait.

What to do If you think a product failed.

Steps that protect your claim.

Step 1

Get medical care

Step 2

Don't let anyone repair, salvage, or throw away the product or vehicle

Step 3

Tell your insurer in writing to hold the vehicle. Then call me

Step 4

Keep the packaging, manuals, and receipts

Step 5

Photograph the product and your injuries

Step 6
